Sam Leib, Brenden Leib and Kate Davis successfully defended an obstetrician regarding the labor and delivery of term neonate who was subsequently diagnosed with cerebral palsy and profound cognitive disabilities. Plaintiffs sought damages in excess of $30 million dollars for economic and non-economic damages of the child and his parents. Although it was agreed by all parties that the plaintiff has profound brain injuries, the timing and etiology of the injury were heatedly disputed. Medical experts in the specialties of neonatology, pediatric neurology, pediatric neuro radiology, neuro developmental pediatrics, and genetics testified that the insult to the fetal brain occurred prior to admission to the hospital. After almost three weeks in trial, the Appleton WI jury of 12 deliberated for 3 hours before rendering their verdict in favor of the defense.
