LKG Attorneys Sean Gaynor and Ashley Brown successfully defended a hospitalist in a six-day jury trial in Waukesha, WI. The hospitalist was involved in the care and treatment of the patient during a three-day hospitalization for pneumonia and hypoxia. Three years after the hospitalization, the patient was diagnosed with an aggressive form of Stage 4 lung cancer. The patient passed away approximately six months after the cancer diagnosis. The spouse and estate of the patient alleged the hospitalist failed to adequately inform the deceased of an abnormal x-ray finding and recommendation for follow up, which they alleged caused a delay in diagnosis of the deceased patient’s cancer. After a six-day trial, with presentation by national experts in the specialties of internal medicine, oncology, pathology, pulmonology and radiology, the jury returned a verdict in favor of the doctor.
