Sam Leib and Brenden Leib argued before the Wisconsin Supreme Court in defense of a health care system as to application of Wisconsin Chapter 655. Seeking to affirm the trial court’s ruling dismissing plaintiff’s wrongful death claim, the justices focused their questions on the distinction between “health care” and “administrative or custodial” care in regard to an elderly woman on the defendant’s health care campus. The novel issue of the application of Chapter 655 to an integrated campus of an acute care hospital, long term skilled nursing and a community based facility should be decided before Summer 2022.
